Terms of sale - ACR Asta16

Condiciones de la Subasta 17-18 de Junio


La participación en las subastas públicas organizadas por ACR Auctions Barcelona S.L. (en adelante, ACR Auctions) supone la aceptación de las condiciones siguientes:

1.Fecha de realización de la subasta

  • La fecha de realización de las subasta será publicada en la página web www.artcoinsroma.com (en adelante, la página web), con antelación suficiente para permitir el conocimiento de los lotes a subastar y poder enviar las órdenes correspondientes.

  • ACR Auctions se reserva el derecho de modificar la fecha de la subasta por causas organizativas o de fuerza mayor.

2.Lotes a subastar

  • Los artículos a subastar podrán ser presentados en lotes individuales o agrupados en lotes de conjunto, siendo de ACR Auctions la potestad de la decisión.

  • Los lotes se conocerán a través de la página web, pudiendo ser examinados personalmente en el lugar, horario y forma oportunamente comunicados en dicha página.

  • Todos los lotes disponen de precio de salida (o precio de reserva), precio de estimación, estado de conservación y catalogación.

    • El precio de salida es el precio mínimo en que puede adjudicarse un lote, no admitiéndose órdenes por un importe inferior a dicho precio.

    • El precio de estimación es el valor de mercado estimado, que es asignado en base al estado de conservación, rareza, y belleza de la pieza.

    • El estado de conservación se asigna siguiendo la escala de gradación utilizada en la numismática española (desde FDC hasta MC). Esta escala, y su equivalencia con otras escalas de gradación utilizadas internacionalmente, está disponible en la página web.

    • La catalogación se realiza siguiendo los catálogos de uso común en la numismática internacional. La bibliografía utilizada para la catalogación y las correspondientes abreviaturas utilizadas están disponibles en la página web.

  • ACR Auctions se reserva la facultad de retirar, con anterioridad a la subasta o durante la realización de esta, cualquier lote que considere justificado.

3.Órdenes anticipadas

  • Las órdenes anticipadas son aquellas que se realizan con anterioridad a la realización de la subasta, y podrán realizarse directamente a través de la página web, o de plataformas de subastas online como SIXBID o NUMISBID.

  • El cierre de admisión de órdenes anticipadas queda fijado a las 13:00 h. del día de la subasta.

  • ACR Auctions no garantiza la recepción de las órdenes anticipadas realizadas a través de plataformas online antes del cierre de admisión, declinando la responsabilidad derivada del funcionamiento de dichas plataformas. Por este motivo, se recomienda efectuar las órdenes anticipadas a través de la página web.

  • Las órdenes recibidas fuera de plazo no serán válidas.

  • Las órdenes se realizarán en euros, y en una cantidad entera (sin céntimos).

  • En caso de recibir dos órdenes anticipadas por mismo lote e idéntico importe, la prioridad de adjudicación será para la orden recibida en primer lugar.

  • ACR Auctions, siempre que lo considere justificado, se reserva el derecho de rechazar cualquier orden de compra.

4.Desarrollo de la subasta

  • ACR Auctions se reserva el derecho de admisión en la sala de subasta.

  • Las ofertas efectuadas durante la realización de la subasta deberán realizarse presencialmente en la sala.

  • El subastador dirige la subasta, teniendo potestad para:

    • establecer discrecionalmente el incremento de las pujas en sala.

    • dirimir cualquier controversia entre pujadores, siendo su decisión final concluyente.

  •  

5.Adjudicación de lotes / Precio de adjudicación

  • Los lotes se adjudicarán al postor que realice la oferta más alta.

  • El precio de adjudicación se determinará a partir de la siguiente expresión:

Precioadjudicación = OfertaB + incremento según cuadro de pujas
siendo:

OfertaB, la oferta recibida por el 2º mayor importe, y los incrementos del Cuadro de Pujas, los siguientes:

6.Precio total de adquisición

  • El precio de adquisición final será igual al precio de adjudicación incrementado en un 18% en concepto de derechos de subasta e I.V.A INCLUIDO.

  • El I.V.A. aplicado es el correspondiente al régimen general, y se aplicará a todos los artículos adquiridos, independientemente de la naturaleza jurídica del comprador y de su país de residencia, según Régimen Especial de Bienes Usados, objetos de arte, antigüedades y objetos de colección (artículos 135 a 139 de la Ley 37/1992 del Impuesto sobre el Valor Añadido).

  • Los compradores que residan en un país no perteneciente a la Unión Europea, y que adquieran artículos a los que sea de aplicación la Ley 16/85 de Patrimonio Histórico Español, deberán cumplir los requisitos establecidos en dicha ley y pagar las correspondientes tasas de exportación (aplicables individualmente a cada uno de los bienes adquiridos).

  • Los gastos de envío, seguro y reembolso correrán siempre por cuenta del comprador.

7.Pago

El pago de los lotes adjudicados se realizará mediante transferencia bancaria o tarjeta de crédito, a partir de la recepción o entrega de la factura.

8.Retirada y envío de lotes

  • Los lotes permanecerán  propiedad del vendedor hasta que la totalidad del pago sea confirmado por la entidad bancaria.

  • Los lotes adjudicados en sala podrán ser retirados durante la subasta o o al término de esta.

  • Los lotes adjudicados a compradores ausentes durante la subasta se enviarán por correo o mensajería, o podrán ser retirados personalmente. En la página web se informará del lugar y horario de retirada de lotes, que habrá de realizarse dentro de los 15 días siguientes a la fecha de realización de la subasta.

Lotes no vendidos

  • Los lotes no vendidos en subasta podrán ser adquiridos posteriormente a través de la página web, a un precio de adjudicación igual al precio de salida.

  • A estos lotes aplican los mismos derechos, impuestos, tasas y gastos que al resto de lotes vendidos.

  • Los lotes no vendidos podrán adquirirse mientras estén disponibles en la página web.

10.Devolución de lotes

  • Se admite la devolución de lotes siempre que obedezca a una causa debidamente razonada y justificada.

  • No será motivo de devolución, salvo error, la discrepancia en cuanto al grado de conservación.

  • Cualquier pieza devuelta debe estar en las mismas condiciones en que fue entregada.

  • La devolución de lotes ha de realizarse en un plazo máximo de siete días naturales a partir de la recepción del artículo. Una vez transcurrido este plazo, no se admitirá devolución alguna.

  • No se admiten devoluciones de lotes de conjunto.

 

La participación en la subastas públicas organizadas por ACR Auctions implican la aceptación de las condiciones y normas descritas. Cualquier caso de litigio será sometido a la jurisdicción de los Tribunales de Barcelona.

 

 

Important information for buyers


- The lots are definitely awarded in the auction room on the day of sale.


- The lots are available for viewing at “Pall Mall Gallery” in 5B Pall Mall – 30 Royal Opera Arcade, London SW1Y 4UY, United Kingdom from 27th to 29th June 2015 from 10:30(GMT+1) to 19:00(GMT+1).


- The offers may be made through our websites (www.acrauctions.it, www.acrauctions.com, www.acrauctions.de, www.acrauctions.co.uk), Sixbid (www.sixbid.com), fax, email, phone or directly to the offices of ACR Auctions. Offers made by email, by fax and through our website and Sixbid, can be received until 14:00 hrs (GMT+1) on June,30th 2015.


- The minimum acceptable bid for each lot is the starting price, lower offers will not be taken into consideration.


- In the event of matching bids on the same lots, the earliest bid will take precedence.


- In the case of only one bid on a lot, the lot will awarded at the opening price. (e.g. if the opening price is £ 1.000 and the only bid offered is £ 1.500, the lot will be awarded at £ 1000).


- In the case of multiple bids on the same lot, it will be awarded to the highest bidder. The calculation of the offer will be made at predetermined increments (view “Predetermined increase”) added to the bid immediately lower than the highest received. (e.g. if the opening price is £ 1.000 and customer (A) offers £ 1,270 while customer (B) offers £ 1,800, the lot will be awarded to customer (B) at £ 1,370 (i.e. with a  predetermined increment of £ 100 over the immediate lower bid of £ 1,270).


- The realized sale prices list will be published on the ACR Auctions website within five days of adjudication.


- Payment for the purchased lots may be made by the following methods:

- Bank cheque or cashier’s check in favour of ACR Auctions LTD with surcharge of £ 15 for foreign checks

- Direct bank transfers in Euro may be made to ACR Auctions LTD with surcharge of £ 15 for outside European Bank transfer:

- Credit card (VISA and MasterCard) are subject to a 3,5% surcharge on the total amount due;

- Paypal is subject to a 3,5% surcharge on the total amount due;


- All lots purchased on the Live-bidding system are subject to an increment 3% on the realized price.


- Payment of purchased items must be made within than 10 days from receipt of the invoice. If the invoice has not been paid within 30 days of the pro-forma invoice date, the interest will be charged at 1% monthly.


-Import costs for countries which require formal import requirements, will be charged to the buyer. In the case of unjustified contestation, by which the coins are returned to ACR Auctions, any customs and courier costs will be payable by the buyer.


- ACR Auctions reserves the right to withdraw any lot. The auctioneer during the auction, has the right to unite or separate lots and possibly vary the order of sale. He may, at its own discretion, withdraw lots if the bids in the auction does not reach the reserve price agreed between ACR Auctions and seller.


- The successful bidder will pay a commission to ACR Auctions, for each lot on the hammer price, of :

  • 23% up to £ 20.000 of hammer price.

  • 19% from £ 20.001 to £ 500.000 of the hammer price.

  • 12% from £ 500.001 of hammer price.

All the sums payable to us by the Buyer are subject to VAT.

- All participants in the auction must, under the validity of an eventual award, complete a registration form with your personal data and the information requested before each auction. To buy you must possess the ability to act as required by law.


- ACR Auctions may accept mandates for the purchase, by making bids by the auctioneer, in competition with the public participating in the auction. ACR Auctions reserves the right to refuse bids from buyers not known unless they do not make a deposit to cover the whole value of the lots desired or, in any case, provided other adequate guarantees.


- The estimates of the possible selling price of each lot are printed under the description of the lots shown in the catalog and don’t include the commissions payable by the successful bidder. These estimates are approximate. The descriptions of the lots in the catalog may be subject to review by the public communications during the auction.


- Lots with more coins not shown are sold as seen and liked and are not subject to return by the buyer.


- All items are guaranteed authentic.


- In case of discrepancies, the Italian version of this terms of sale prevails.

TERMS AND CONDITIONS


This notice is addressed by Acr Auctions to any person who may be interested in a Lot. An additional information applicable to the Sale may be set out in the Catalogue for the Sale, in an insert in the Catalogue and/or in a notice displayed at the Sale venue and you should read them as well.


1. OUR ROLE

In its role as Auctioneer of Lots, Acr Auctions acts solely for and in the interests of the Seller. Our experts are available to prospective buyers to give information about lots for sale.

The Seller has authorized Acr Auctions to sell the Lot as its agent on its behalf and, save where we expressly make it clear to the contrary, Acr Auctions acts only as agent for the Seller. Any statement or representation we make in respect of a Lot is made on the Seller’s behalf.

Acr Auctions does not owe or undertake or agree to any duty or responsibility to you in contract or tort (whether direct, collateral, express, implied or otherwise). If you successfully bid for a Lot and buy it, at that stage Acr Auctions does enter into an agreement with the Buyer. The terms of that contract are set out in our Buyer’s Agreement, which you will find beneath.


2. LOTS

Subject to the Contractual Description printed in bold letters in the Entry about the Lot in the Catalogue, Lots are sold to the Buyer on an “as is” basis, with all faults and imperfections. Illustrations and photographscontained in the Catalogue (other than photographs forming part of the Contractual Description) or elsewhere of any Lots are for identification purposes only. They may not reveal the true condition of the Lot. A photograph or illustration may not reflect an accurate reproduction of the color(s) of the Lot. Lots are available for inspection prior to the Sale and it is for you to satisfy yourself as to each and every aspect of a Lot, including its authorship, attribution, condition, provenance, history, background, authenticity, style, period, age, suitability, quality, roadworthiness (if relevant), origin, value and estimated selling price. It is your responsibility to examine any Lot in which you are interested. It should be remembered that the actual condition of a Lot may not be as good as that indicated by its outward appearance. We can assist in arranging facilities for you to carry out or have carried out more detailed inspections and tests. Please ask our staff for details. Any person who damages a Lot will be held liable for the loss caused.


3. DESCRIPTIONS OF LOTS AND ESTIMATES

Contractual Description of a Lot

The Catalogue contains a description of our experts and an image about each Lot.

Estimates

The estimate is printed beside the description. Estimates are only an expression between Acr Auctions and the Seller. It does not take into account any VAT or Buyer’s fees. The estimate of each lot is in pound.

Condition Reports

ACR Auctions can give to all customer the Condition Report on each lot. If you do so, this will be provided by Acr Auctions on behalf of the Seller free of charge.

The Seller’s responsibility to you

The seller undertakes to respect all contractual obligations listed here relating the sale of the items in the auction.

Acr Auctions’ responsibility to you

Acr Auctions acts as an intermediary for the sale and it assumes the commitment to allow analysis, study or test for the interest of the seller and buyer unless they are invasive or damaging the item.

Alterations

Descriptions and Estimates may be amended at Acr Auctions’ discretion from time to time by notice given orally or in writing before or during a Sale or by publication. Each lot is available for examine before the sale.


4. CONDUCT OF THE SALE

Our Sales are public auctions which persons may attend and you should take the opportunity to do so. We do reserve the right at our sole discretion to refuse admission to our premises or to any Sale without stating a reason. We have complete discretion as to whether the Sale proceeds, whether any Lot is included in the Sale, the manner in which the Sale is conducted and we may offer Lots for Sale in any order we choose notwithstanding the numbers given to Lots in the Catalogue. You should therefore check the date and starting time of the Sale, whether there have been any withdrawals or late entries. Remember that withdrawals and late entries may affect the time at which a Lot you are interested in is put up for Sale. We have complete discretion to refuse any bid, to nominate any bidding increment we consider appropriate, to divide any Lot, to combine two or more Lots, to withdraw any Lot from a Sale and, before the Sale has been closed, to put up any Lot for auction again.

We are not responsible to you in respect of the presence or absence of any Reserve in respect of any Lot. If there is a Reserve it will normally be no higher than the lower figure for any Estimate in the Catalogue, assuming that the currency of the Reserve has not fluctuated adversely against the currency of the Estimate. The Buyer will be the Bidder who makes the highest bid acceptable to the Auctioneer for any Lot (subject to any applicable Reserve) to whom the Lot is knocked down by the Auctioneer at the fall of the Auctioneer’s hammer.

Any dispute as to the highest acceptable bid will be settled by the Auctioneer in his absolute discretion. All bids tendered will relate to the actual Lot number announced by the Auctioneer. An electronic currency converter may be used at the Sale. This equipment is provided as a general guide as to the equivalent amount in certain currencies of a given bid. We do not accept any responsibility for any errors which may occur in the use of the currency converter. We may use video cameras to record the Sale.

5. BIDDING

We do not accept bids from any person who has not completed and delivered to us one of our Bidding Forms,either our Bidder Registration Form, Absentee Bidding Form or Telephone Bidding Form. You will be asked for proof of identity, residence and references, which, when asked for, you must supply if your bids are to be accepted by us. Please bring your passport, driving license (or similar photographic proof of identity) and proof of address. We may request a deposit from you before allowing you to bid. We may refuse entry to a Sale to any person even if that person has completed a Bidding Form.

Bidding in person

You should come to our Bidder registration desk at the Salevenue and fill out a Bidder Registration Form on (or, if possible,before) the day of the Sale. The bidding number system issometimes referred to as “paddle bidding”. You will be issuedwith a large card (a “paddle”) with a printed number on it. This will be attributed to you for the purposes of the Sale.Should you be a successful Bidder you will need to ensure that your number can be clearly seen by the Auctioneer and that it is your number which is identified as the Buyer’s. You should not let anyone else use your paddle as all Lots will be invoiced to the name and address given on your Bidder Registration Form. Once an invoice is issued it will not be changed. If thereis any doubt as to the Hammer Price of, or whether you are thesuccessful Bidder of, a particular Lot, you must draw this to the attention of the Auctioneer before the next Lot is offered for Sale. At the end of the Sale, or when you have finished bidding please return your paddle to the Bidder registration desk.

Bidding by telephone (only available on lots with a low estimate greater than £500)

If you wish to bid at the Sale by telephone, please complete aTelephone Bidding Form, which is available from our offices orin the Catalogue. Please then return it to the office responsible

for the Sale at least 24 hours in advance of the Sale. It is yourresponsibility to check with our Bids Office that your bid hasbeen received. Telephone calls will be recorded. The telephone bidding facility is a discretionary service and may not be available in relation to all Lots. We will not be responsible for bidding on your behalf if you are unavailable at the time of the Sale or if the telephone connection is interrupted during bidding. Our staff will be available for phone calls in foreign languages as long as previously agreed.

Bidding by post or fax

Absentee Bidding Forms can be found in the back of this Catalogue and should be completed and sent to the office responsible for the Sale. It is in your interests to return your form as soon as possible, as if two or more Bidders submit tidentical bids for a Lot, the first bid received takes preference. In any event, all bids should be received at least 24 hoursbefore the start of the Sale. Please check your Absentee Bidding Form carefully before returning it to us, fully completed and signed by you. It is your responsibility to check with our Bids Office that your bid has been received. This additional service is complimentary and is confidential. Such bids aremade at your own risk and we cannot accept liability for our failure to receive and/or place any such bids. All bids made on your behalf will be made at the lowest level possible subject to Reserves and other bids made for the Lot. Where appropriate your bids will be rounded down to the nearestamount consistent with the Auctioneer’s bidding increments. New Bidders must also provide proof of identity and address when submitting bids. Failure to do this will result in your bid not being placed.

Bidding through an agent

Bids will be accepted as placed on behalf of the person named as the principal on the Bidding Form although we may refuseto accept bids from an agent on behalf of a principal and willrequire written confirmation from the principal confirmingthe agent’s authority to bid. 6. CONTRACTS BETWEEN THE BUYER AND SELLER AND THE BUYER AND ACR AUCTIONS

On the Lot being knocked down to the Buyer, a Contract for Sale of the Lot will be entered into between the Seller and the Buyer on the terms of the Contract for Sale set out in Appendix 1 at the back of the Catalogue. You will be liable to pay the Purchase Price, which is the Hammer Price plus any applicable VAT. At the same time, a separate contract is also entered into between us as Auctioneers and the Buyer. Please read the terms of the Contract for Sale and our Buyer’s Agreement contained in the Catalogue in case you are the successful Bidder. We may change the terms of either or both of these agreements in advance of their being entered into, by setting out different terms in the Catalogue and/or by placing an insert in the Catalogue and/or by notices at the Sale venue and/or by oral announcements before and during the Sale.



7. BUYER’S PREMIUM AND OTHER CHARGES PAYABLE BY THE BUYER

Under the Buyer’s Agreement, a premium (the Buyer’s Premium) is payable to us by the Buyer in accordance with the terms of the Buyer’s Agreement and at rates set out below,calculated by reference to the Hammer Price and payable in addition to it. Storage charges and Expenses are also payableby the Buyer as set out in the Buyer’s Agreement. All the sums payable to us by the Buyer are subject to VAT. For this Sale the following rates of Buyers Premium will be payable by Buyers of Lots:

  • 23% up to 20,000 of the Hammer Price

  • 19% from 20,001 to 500,000 of the Hammer Price

  • 12% from 500,001 of the Hammer Price

In order to harmonize tax procedures among EU countries, with effect from 1 January 2001 new rules were introduced with the extension to the Auction Houses of the margin scheme. Article. 45 of Law 342 of 21 November 2000 provides for the application of the scheme to sales concluded in execution of contracts of commission defined:
• private clients;
• clients to tax that the operation subject to the margin scheme;
• Customers who have not been able to deduct the tax in accordance with Art. 19, 19 bis, and 19-bis2 the DPR. 633/72 (which have sold well in free ex-Art. 10, 27-d)
• customers who benefit from the exemption arrangements provided for small businesses in the State of origin.
By virtue of special legislation, in cases mentioned above any VAT tax, or a sum in lieu of VAT, if applicable, it is charged by the Auction House. No symbol will be used for lots sold under the margin scheme.



8. PAYMENT

The payment of the sold lots must be made immediately after the auction and can be made by bank transfer, cash, check, bank check bank account, credit card (Visa or Mastercard).
Acr Auctions billed to the same person that is at the registration of the pallet unless otherwise agreed previously agreed with the Administration.
As required by law, Acr Auctions is obliged to call for their customers to show an identity document (identity card, driving license, passport) and confirmation of address.
The buyer intends to pay by check’s bank must make arrangements with the Administration. It’s not possible deliver the goods before the payment by check or bank draft until encashment of the check, unless otherwise agreed prior to the auction.

Payment can be made by Visa or Mastercard only by the cardholder.
Acr Auctions reserves the right to check the source of the payments received. Acr Auctions reserves the right to refuse payments received from different people by the purchaser. However, in limited circumstances and in any case with the consent of the seller, Acr Auctions has the ability to offer buyers it deems reliable the option of paying for goods purchased at cadences deferred. The mode of deferred payment will be set out before the sale. Before considering whether or not to grant deferred payments, Acr Auctions may ask for references and documentation on the reliability of the buyer's identity and reliability. It will not allow anyone to withdraw the lot until it will be canceled, unless it has been granted a credit before the auction.



9. COLLECTION

It is ACR Auctions policy to request proof of identity on collection of a lot. Lots will be released to you or your authorized representative when full and cleared payment has been received by ACR Auctions.


10. STORAGE

Storage and handling charges may apply.

11. LOSS OR DAMAGE

Buyers are reminded that ACR Auctions accepts liability for loss or damage tolots for a maximum period of ten (10) days afterthe date of the auction.


12. SHIPPING

ACR Auctions Shipping Department can advise buyers on exporting and shipping property. You can contact the Customer service on the number that you see in our website.

All of the cost concerning the shipment must be payable by the buyer. Additionally, a form to provide shipping instructions is attached to the buyer’s invoice. Your shipper will include a quote for transit insurance. All shipments should be unpacked and checked on delivery and any discrepancies notified to the transit insurer or shipper immediately.


13. THE SELLERS AND/OR ACR AUCTIONS’ LIABILITY

Besides the responsibilities and obligations of sellers and ACR Auctions above, neither sellers nor ACR Auctions shall be held responsible for any error in the description of the lots or in their estimates for the sale and for any omissions that may result in losses or damage to property or assets to the purchaser.


14.DATA PROTECTION – USE OF YOUR INFORMATION

Where we obtain any personal information about you, we shallonly use it in accordance with the terms of our Privacy Policy(subject to any additional specific consent(s) you may havegiven at the time your information was disclosed).
