Terms of sale - ACR Numismatic Auction 19
Important information for buyers
- The lots are definitely awarded in the auction room on the day of sale.
- The lots are available for viewing at “The Charles Hotel” in Sophienstraße 28, 80333 Munich, Germany on 10th November 2015 from 10:30 to 19:00.
- The offers may be made through our websites (www.bertolami.it, www.acrauctions.com, www.artcoinsroma.com), Sixbid (www.sixbid.com), Numisbids (www.numisbids.com), fax, email, phone or directly to the offices of ACR Auctions. Offers made by email, by fax and through our website, can be received until 12:00 hrs (CET) on November 11th, 2015 for lots 1-586 and until 12:00 hrs (CET) on November 12th, 2015 for lots 587-1192. Offers made through Numisbids can be received until 12:00 hrs (CET) on November 11th, 2015.
- The minimum acceptable bid for each lot is 80% of the pre-sale estimate, lower offers will not be taken into consideration.
- In the event of matching bids on the same lots, the earliest bid will take precedence.
- In the case of only one bid on a lot, the lot will awarded at the opening price. (e.g. if the opening price is € 1.000 and the only bid offered is € 1.500, the lot will be awarded at € 1000).
- In the case of multiple bids on the same lot, it will be awarded to the highest bidder. The calculation of the offer will be made at predetermined increments (view “Predetermined increase”) added to the bid immediately lower than the highest received. (e.g. if the opening price is € 1.000 and customer (A) offers € 1,270 while customer (B) offers € 1,800, the lot will be awarded to customer (B) at € 1,370 (i.e. with a predetermined increment of € 100 over the immediate lower bid of € 1,270).
- The realized sale prices list will be published on the ACR Auctions website within five days of adjudication.
- Payment for the purchased lots may be made by the following methods:
- Bank cheque or cashier’s check in favour of ACR Auctions GmbH with surcharge of € 5 for foreign checks
- Direct bank transfers in Euro may be made to ACR Auctions GmbH with surcharge of € 10 for outside European Bank transfer:

- Credit card (VISA and MasterCard) are subject to a 3,5% surcharge on the total amount due;
- Paypal is subject to a 3,5% surcharge on the total amount due;
- All lots purchased on the Live-bidding system are subject to an increment 2,5% on the realized price.
- Payment of purchased items must be made within than 10 days from receipt of the invoice. If the invoice has not been paid within 30 days of the pro-forma invoice date, the interest will be charged at 1%.
-Import costs for countries which require formal import requirements, will be charged to the buyer. In the case of unjustified contestation, by which the coins are returned to ACR Auctions, any customs and courier costs will be payable by the buyer.
- ACR Auctions reserves the right to withdraw any lot. The auctioneer during the auction, has the right to unite or separate lots and possibly vary the order of sale. He may, at its own discretion, withdraw lots if the bids in the auction does not reach the reserve price agreed between ACR Auctions and seller.
- The successful bidder will pay a commission to ACR Auctions, for each lot, of 22% on the hammer price.
- All participants in the auction must, under the validity of an eventual award, complete a registration form with your personal data and the information requested before each auction. To buy you must possess the ability to act as required by law.
- ACR Auctions may accept mandates for the purchase, by making bids by the auctioneer, in competition with the public participating in the auction. ACR Auctions reserves the right to refuse bids from buyers not known unless they do not make a deposit to cover the whole value of the lots desired or, in any case, provided other adequate guarantees.
- The estimates of the possible selling price of each lot are printed under the description of the lots shown in the catalog and don’t include the commissions payable by the successful bidder. These estimates are approximate. The descriptions of the lots in the catalog may be subject to review by the public communications during the auction.
- Lots with more coins not shown are sold as seen and liked and are not subject to return by the buyer.
- All items are guaranteed authentic.
- In case of discrepancies, the Italian version of this terms of sale prevails.
Terms and Conditions of Business
1- Area of validity
Our below General Terms and Conditions apply to all legal transactions between Acr Auctions GmbH and the customer. We expressly do not recognize any purchasing conditions witch deviate from our General Terms and Conditions.
An acknowledgement of different purchasing terms applies only if we have confirmed such application in writing.
2- Conclusion of Contract
Your order constitutes a legally-binding offer to us to conclude a purchasing contract.
A legally-valid purchasing contract only takes effect if we have accepted your offer within 14 days.
This is done by our confirming the order in writing or by sending the ordered product to you. We shall confirm receipt of an order placed via the internet immediately by sending an e-mail to the e- mail address you have given. This confirmation of receipt is not yet a binding acceptance of the order, although our declaration of acceptance can be combined with a confirmation of receipt. No liability is accepted for the accuracy, completeness and up-to-dateness of the texts and images in the internet and in catalogues. Texts and images are subject to misprints and error.
Verbal information provided without a written order is not binding and must be set down in writing to become effective. Upon placing an order you accept our General Terms and Conditions.
3- Cost of shipping and insurance
The cost of shipping and insurance of the purchased lots is calculated according to the tables below published on our website www.artcoinsroma.com (de, it, co.uk)
4- Terms of Delivery and Delivery Period
Items are only delivered after payment in advance, particularly to purchasers unknown to us, unless otherwise agreed. If awarded, an invoice shall be sent to you when we accept your offer which you must pay within 10 days. After receipt of payment we shall send the goods to you within 14 days.
If we are temporarily unable to deliver the purchased item within the agreed delivery period, or within 14 days, or to duly fulfill the contract due to shutdowns, strikes, lockouts, regulatory actions or other cases of force majeure, the delivery period shall be extended by the duration of the hindrance. In this case, we shall immediately inform the customer of the hindrance and its anticipated duration. Should the hindrance persist beyond four weeks, both parties shall thus have the right to rescind the contract.
If the buyer is a consumer, for a mail-order purchase the risk of incidental demise or deterioration of the purchased item is only transferred when the merchandise is handed over to the buyer. The merchandise shall be considered handed over if the consumer is in default of accepting the purchased merchandise. Shipping is covered under appropriate insurance policies.
5- Payment
All prices are in Euros, including any value-added tax applicable at the time of the order.
Any other taxes, along with import and export taxes, are to be paid by the customer. Wherever applicable, the customer is to inquire about this beforehand or contact us.
In the case of cash in advance and delivery on open account, payment is to be made to one of our following bank accounts within 10 days after receiving an invoice:

6- Right of Withdrawal
The customer can exercise the right of withdrawal within 7 days from the date of delivery of the goods. This right can be exercised by the customer only if the good has serious defects not visible and not reported in the description. The notice of cancellation must be sent to:

Effects of withdrawal
In the event of a valid withdrawal, each party shall return to the other party any benefits received (e.g. interest)
In case you are unable to return the items or services rendered by us in whole or part, or only return them in a deteriorated condition, you may be required to pay us compensation.
If the goods purchased appear to have been damaged before shipping, the customer shall not make any compensation
Any items that are unsuitable for dispatch will be collected at your address.
Obligations to reimburse payments must be fulfilled within 30 days. For you this term begins when you dispatch either your declaration of revocation or the items; for us it begins upon their receipt.
7- Reservation of Title
ACR Auctions has entitled to resell the goods transferred in the ordinary course of business.
The customer seller, in the time of placing, give us all grants on the goods on sale.
The consignor is entitled to payment the agreed price only after buyer under paid off itself purchased good.
Acr Auctions will be responsible for the collection of the sales price until the expiry of contract terms of payment.
In contracts with consumers, we retain the title to goods until full payment of the purchase price has been made. In contracts with companies, we retain the title to goods until all claims from an ongoing business relationship have been satisfied.
As long as the purchase price has not been paid in full, the customer is obliged:
a) to handle the merchandise with care, in particular to not clean or treat them with chemicals or other objects;
b) to notify us immediately if a third party has placed a claim, such as a lien, on the goods, or if the goods have suffered damage or demise and/or;
c) change of ownership of the goods has occurred, as well as a change in the buyer’s own domicile.
An entrepreneur has the right to sell the goods to a third party in the course of normal business. In doing so, he already assigns to us all receivables vis-à-vis third parties that accrue to him by reselling the goods in the amount of the invoiced value. We already accept this assignment. Subsequent to assignment, the company is entitled to collect the receivables. We do, however, reserve the right to collect the receivables ourselves, if the company does not duly fulfill its payment obligations and falls into default.
8- Liability for Defects
Should the articles delivered prove to have obvious defects, whereby this also includes shipping damage, you are obliged to file a claim for such defects without delay. If you are a consumer, the failure to give notice of defect, however, shall not have any consequences on your legal rights.
There may exist multiple copies of individual pieces. Not all pieces can be illustrated or listed in a catalogue or on the website. The delivery of a piece not illustrated in the catalogue does not constitute a defect, unless you have expressly stated in your order that you wish to receive exactly the piece illustrated and described.
The authenticity of all goods offered is guaranteed. The buyer is entitled to all the warranties required by law.
As regards warranty, the consumer has the choice of exercising his right of removal of defects or delivery of merchandise free of defects (supplementary performance). To the extent that the method of supplementary performance is considered to entail disproportionate costs, the entitlement shall be limited to the remaining options for supplementary performance. Additional rights, in particular the rescission of the purchase contract, can only be exercised after an adequate period of time has passed, allowing for supplementary performance or two unsuccessful attempts of supplementary performance or if ACR Auctions have refused supplementary performance.
If the seller is an entrepreneur, we are entitled to choose to either remove defects or deliver merchandise free of defects within one year after date of delivery pursuant to § 439 BGB. After a year has passed after the date of delivery, the warranty claims of a business entity are limited to the removal of defects or the provision of a credit of the current cash value, whichever we deem appropriate.
9- Data privacy
All personal data will be kept strictly confidential and will not be made available to third parties.
10- Liability Disclaimer
In all cases where ACR Auctions are obliged on the basis of contractual or legal grounds to pay for damages or reimbursements, we are only liable to the extent that we have been proven to have acted willfully and with gross negligence or to have caused injury to life, limb, or health. This shall not affect liability regardless of negligence or fault according to the Product Liability Act. Nor shall it affect liability for gross breach of contract; to this degree, liability is limited to damages that are foreseeable and typical for this type of contract, except for the cases referred to in the first two sentences. The aforementioned provisions are not coupled with a change in the burden of proof to the disadvantage of the customer.
11- Applicable law and jurisdiction
The place of fulfillment is Monaco di Baviera,head office of ACR Auctions GmbH. German law shall apply at the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
The same applies if the customer has no general legal venue in the Federal Republic of Germany or his domicile or normal place of abode is not known at the time a lawsuit is filed.
Should any of the provisions of this contract with the customer, including these General Terms and Conditions, be determined unlawful in part or whole, this shall not invalidate the remaining provisions. In case there is an unforeseen eventuality, the parties shall agree upon provisions that, on the basis of the entire body of the contract, shall help execute the contract according to the apparent will of both parties.
Those participants automatically accepted these Terms and Conditions of sale and are available to any interested party on request.

- I lotti verranno aggiudicati definitivamente in sala durante l’asta.
- Tutti i lotti saranno visibili direttamente presso “The Charles Hotel” in Sophienstraße 28, 80333 München, Germania il giorno 10 Novembre 2015 dalle ore 10:30 alle ore 19:00.
- Le offerte potranno essere effettuate attraverso i nostri indirizzi web (www.bertolami.it, www.acrauctions.com, www.artcoinsroma.com) o il portale Sixbid (www.sixbid.com), Numisbids (www.numisbids.com), via fax, via email, telefonicamente o direttamente presso le sedi di ACR Auctions. Le offerte via email, via fax, tramite Sixbid e attraverso il nostro sito potranno essere effettuate sino alle ore 12:00 del 11 Novembre 2015 per i lotti 1-586 e sino alle ore 12:00 del 12 Novembre 2015 per i lotti 587-1192. Le offerte tramite il portale Numisbids potranno essere effettuate sino alle ore 12:00 del 11 Novembre 2015.
- L’offerta minima per ciascun lotto sarà pari all’80% del prezzo di stima. Offerte inferiori non verranno prese in considerazione.
- A parità di offerta sul medesimo lotto ed in assenza di nuove offerte in sala, quest’ultimo verrà assegnato all’offerta con data anteriore.
- In caso di una sola offerta su un lotto, l’importo di aggiudicazione sarà quello dell’importo di base.
Esempio: importo base € 1.000,00. Importo unica offerta € 1.500,00. Il lotto viene aggiudicato al cliente che ha effettuato l’unica offerta per € 1.000,00.
- In caso di offerte multiple sul medesimo lotto, l’offerta vincente sino a quel momento verrà calcolata mediante un incremento prestabilito (vedi tabella “Predetermined increase”) da aggiungere alla offerta immediatamente inferiore rispetto a quella più alta ricevuta.
Esempio: prezzo base € 1.000,00. Cliente (A) offerta € 1.270,00. Cliente (B) € 1.800,00. In tal caso l’offerta vincente sarà quella del cliente (B) per l’importo di € 1.370,00 (ossia con l’incremento prestabilito come da tabella per lo scaglione corrispondente pari ad € 100,00 oltre l’offerta immediatamente inferiore di € 1.270,00).
- L’elenco delle aggiudicazioni verrà pubblicato da ACR Auctions sul proprio sito, ai soli fini informativi entro cinque giorni dalla chiusura dell’asta.
- Il pagamento dei lotti aggiudicati potrà avvenire come segue:
- assegno bancario o circolare non trasferibile intestato ad ACR Auctions GmbH, con aggiunta all’importo della fattura di € 5,00 per gli assegni esteri.
- bonifico bancario a favore di ACR Auctions GmbH con aggiunta all’importo della fattura di € 10,00 per i bonifici extra-Europei da effettuarsi su:

- I lotti aggiudicati con il sistema Livebidding avranno un incremento del 2,5% sul prezzo di aggiudicazione.
- Il pagamento dei lotti aggiudicati dovrà avvenire entro e non oltre 10 giorni dal ricevimento della fattura di acquisto. A partire dal 30° giorno della data della fattura pro-forma, verranno calcolati 1% di interessi di mora.
- I costi doganali e di spedizione sono a carico del compratore. Nel caso in cui, per contestazioni ingiustificate, le monete dovessero essere restituite ad ACR Auctions, le spese doganali e di spedizione sono a carico del cliente.
- ACR Auctions si riserva la facoltà di ritirare dall'asta qualsiasi lotto. Il banditore, durante l’asta, ha facoltà di abbinare o separare i lotti ed eventualmente variare l’ordine di vendita. Lo stesso potrà, a proprio insindacabile giudizio, ritirare i lotti qualora le offerte in asta non raggiungano il prezzo di riserva concordato tra ACR Auctions e venditore.
- L' aggiudicatario corrisponderà a ACR Auctions una commissione d'asta, per ciascun lotto, pari al 22% sul prezzo di aggiudicazione.
- A tutti i partecipanti all'asta è richiesto, ai sensi della validità di un eventuale aggiudicazione, di compilare una scheda di partecipazione con i dati personali e le informazioni richieste, prima di ogni asta. Per poter effettuare acquisti è necessario possedere la capacità di agire richiesta dalla legge.
- ACR Auctions può accettare mandati per l’acquisto, effettuando rilanci mediante il banditore, in gara con il pubblico partecipante all’asta. ACR Auctions si riserva il diritto di rifiutare le offerte di acquirenti non conosciuti a meno che non venga rilasciato un deposito a intera copertura del valore dei lotti desiderati o, in ogni caso, fornita altra adeguata garanzia.
- Le stime relative al possibile prezzo di vendita di ciascun lotto sono stampate sotto la descrizione dei lotti riportata nel catalogo e non includono i diritti d'asta dovuti all'aggiudicatario. Tali stime sono puramente indicative. Le descrizioni dei lotti nel catalogo potranno essere soggette a revisione, mediante comunicazioni al pubblico durante l'asta.
- I lotti contenenti più monete non illustrate sono venduti come visti e piaciuti e non sono soggetti a resa da parte dell’acquirente.
- Tutte le monete sono garantite autentiche
Condizioni generali di vendita
1- Ambito di applicazione
Le “Condizioni generali di vendita” che vengono di seguito indicate si applicano a tutti i negozi giuridici tra ACR Auctions e i clienti. Non vengono espressamente riconosciute eventuali condizioni di acquisto che differiscono dalle “Condizioni generali di vendita” di seguito riportate.
Condizioni di vendita diverse dalle presenti acquisteranno validità soltanto se a seguito di una nostra conferma scritta.
2- Sottoscrizione del contratto
L’ordine del cliente costituisce offerta giuridicamente vincolante nei nostri confronti ai fini dell’acquisto.
L’acquisto sarà valido a tutti gli effetti di legge solo se l’offerta verrà accettata dalla nostra società entro 14 giorni dalla data di comunicazione.
L’offerta sarà accettata mediante conferma scritta o direttamente con la spedizione dei beni ordinati.
Gli ordini effettuati su internet, verranno immediatamente confermati tramite la spedizione di una email inviata al vostro indirizzo.
Tuttavia tale conferma di ordine non costituisce un impegno definitivo da parte di ACR Auctions.
Le descrizioni presenti nei cataloghi e su internet sono puramente indicative pertanto si declina qualsiasi responsabilità in merito alla correttezza delle stesse.
La società non è altresì responsabile in caso di palesi errori di stampa.
Gli ordini devono avere forma scritta. Eventuali ordini effettuati verbalmente non sono vincolanti.
Effettuare un’ordine, determina automaticamente l’accettazione delle nostre “Condizioni generali di vendita”.
3- Spese di spedizione ed assicurazione
Le spese di spedizione ed assicurazione dei lotti acquistati verranno calcolate in base alle tabelle pubblicate nel nostro sito www.artcoinsroma.com (de, it, co.uk)
4- Termini di consegna
La consegna di beni acquistati, in particolare effettuata da nuovi clienti, verrà effettuata soltanto previo pagamento anticipato, salvo diverso accordo.
In caso di aggiudicazione, verrà inviata al cliente acquirente una fattura, che dovrà essere pagata entro e non oltre 10 giorni dalla ricezione.
La merce verrà inviata entro 14 giorni dalla data di avvenuto pagamento.
Qualora fossimo temporaneamente impossibilitati a consegnare la merce acquistata entro il termine stabilito di 14 giorni a causa di blocchi, scioperi, serrate, azioni normative o altri casi di forza maggiore, il termine di consegna verrà automaticamente prorogato.
In questo caso il cliente verrà tempestivamente informato anche riguardo la durata prevista. Se l’impedimento dovesse persistere oltre le quattro settimane, entrambe le parti avranno il diritto di rescindere il contratto.
Il rischio di danneggiamento e deterioramento accidentale della merce venduta, passa all’acquirente nel momento della consegna diretta della merce. Se la merce viene inviata mediante spedizioniere, la responsabilità è del vettore o alla persona incaricata per la consegna della merce sino a consegna avvenuta.
Gli oggetti acquistati si considerano consegnati anche se l’acquirente li ritira in ritardo.
La spedizione è coperta da adeguate polizze assicurative.
5- Pagamento
Tutti i prezzi sono in Euro, inclusa l’imposta sul valore aggiunto in vigore al momento dell'ordine.
Eventuali ulteriori imposte, quali dazi di importazione o esportazione, sono a carico del cliente.
A tale riguardo, il cliente dovrà informarsi autonomamente oppure contattarci.
Il pagamento dovrà essere effettuato su uno dei conti bancari di ACR Auctions entro 10 giorni dal ricevimento della fattura.

6- Diritto di recesso
E’ possibile esercitare il diritto di recesso entro 7 giorni dalla data di consegna dei beni. Tale diritto può essere esercitato dal cliente esclusivamente se il bene presenta gravi difetti non visibili e non segnalati nella descrizione. La dichiarazione di recesso dovrà essere indirizzata a:

Effetti del recesso
In caso di recesso affinché lo stesso sia valido, ciascuna parte deve restituire all'altra eventuali benefici ricevuti (es. interessi).
Nel caso in cui non sia possibile restituire i beni acquistati o nel caso in cui tali beni siano in tutto o in parte danneggiati, la parte acquirente è obbligata a fornire un adeguato risarcimento.
L’acquirente non deve effettuare alcun risarcimento se i beni acquistati risultano essere stati danneggiati prima della spedizione.
Il rimborso dovrà essere effettuato entro 30 giorni.
Per l’acquirente il termine decorre dalla data di invio della dichiarazione di recesso o dall’invio della merce stessa, per la nostra società, dalla data di restituzione della merce.
7- Riserva di proprietà
ACR Auctions ha diritto di vendere i beni conferiti nell’esercizio della propria attività.
Il cliente venditore cede dal momento del conferimento a ACR Auctions tutti i diritti sui beni posti in vendita.
Il conferente ha diritto al pagamento del prezzo pattuito solo dopo che il compratore ha pagato a sua volta il bene acquistato.
ACR Auctions si occuperà della riscossione del prezzo di vendita sino alla scadenza dei termini di pagamento contrattuali.
Nei contratti con i privati ACR Auctions si riserva la proprietà della merce sino al totale pagamento del prezzo.
Nei contratti con i commercianti ACR Auctions si riserva la proprietà della merce sino al pagamento di tutti i crediti in essere.
Fino al totale pagamento del prezzo il compratore è obbligato a:
trattare la merce con cura evitando qualsiasi intervento di pulitura sia chimico che meccanico;
non consentire a terzi di entrare in possesso dei beni acquistati come ad esempio in caso di pignoramento e a evitare il danneggiamento o la distruzione degli stessi;
comunicare immediatamente il trasferimento di possesso dei beni nonché il cambio di domicilio
8- Responsabilità per difetti
Se i beni acquistati dovessero presentare vizi palesi, tra i quali anche danni da trasporto, il compratore è obbligato a comunicare immediatamente a ACR Auctions l’esistenza di tali vizi o danni.
Se il compratore è un privato, la mancata denuncia di tali danni non ha conseguenza sui diritti acquisiti.
Può accadere che singoli pezzi siano disponibili in più esemplari uguali. Non è sempre possibile illustrare o elencare tutti i pezzi in un catalogo o sul sito internet. La fornitura di un pezzo uguale non illustrato non costituisce inadempimento contrattuale, salvo che abbiate espressamente indicato nell'ordinazione di voler ricevere esattamente il pezzo illustrato e descritto.
Si garantisce l'autenticità di tutti i beni offerti in asta. Al committente spettano tutti i diritti di garanzia previsti dalla legge.
L’acquirente privato ha facoltà di chiedere a sua scelta, ove possibile, la rimozione del vizio o la fornitura di merce equivalente priva non danneggiata (adempimento a posteriori).
Se il tipo di adempimento a posteriori scelto dovesse essere connesso a spese di entità sproporzionata, il diritto di garanzia si perfeziona nell’altro modo previsto.
Ulteriori diritti, in particolare quello del recesso dal contratto, potranno essere rivendicati soltanto dopo il decorso di un termine adeguato per l'adempimento a posteriori, oppure dopo due tentativi di adempimento a posteriori falliti, oppure anche nel caso in cui ACR Auctions si rifiuta di effettuare l'adempimento a posteriori.
Se il venditore è un commerciante, ACR Auctions ha la facoltà di scegliere fra la rimozione dei vizi o la fornitura di merce non danneggiata entro un anno a decorrere dalla data di consegna, conformemente al § 439 BGB. Decorso di un anno dalla data di consegna, i diritti di garanzia dell'imprenditore si limitano alla rimozione dei vizi oppure ad un accredito del valore attuale della merce, a scelta di ACR Auctions.
9- Protezione dei dati
Tutti i dati personali sono normalmente oggetto di segretezza e non vengono trasmessi a terzi.
10- Limitazione della responsabilità
ACR Auctions è obbligata prestare risarcimento danni in base alle disposizioni contrattuali o alle norme vigenti in materia e nei casi ai casi in cui sia imputabile alla stessa dolo, colpa grave o responsabilità per l’integrità fisica dei clienti.
La responsabilità oggettiva prevista dalla normativa di legge per la garanzia sul prodotto non viene toccata.
Non viene intaccata la responsabilità derivante da un inadempimento di essenziali obblighi contrattuali.
La responsabilità sarà tuttavia limitata, salvo i casi previsti ai capoversi 1 e 2, a danni prevedibili, tipici del rapporto contrattuale.
Le suddette disposizioni non comportano una modifica a svantaggio del cliente dell'onere della prova.
11- Diritto applicabile e foro competente
Il Foro competente per qualsiasi controversia è quello di Monaco di Baviera sede della ACR Auctions GmbH.
La legge applicata è quella tedesca con l'esclusione della Convenzione delle Nazioni Unite sui contratti per la vendita internazionale di beni.
Tale norma si applica anche se il foro competente per il cliente non è in Germania e anche se non è conosciuta la sua residenza o il domicilio abituale al momento dell’avvio dell'azione legale.
L’eventuale inefficacia di una o più disposizioni indicate nelle presenti “Condizioni generali di vendita” non intacca la validità delle rimanenti disposizioni.
Le disposizioni ritenute parzialmente o totalmente illegittime, saranno sostituite da altre aventi un valore economico equivalente.
Nel caso in cui vi sia una eventualità imprevista, le parti provvederanno a stipulare un accordo che sia valido per entrambi in conformità con il contenuto del contratto stesso.
Le presenti condizioni di vendita sono accettate automaticamente da quanti concorrono all'asta e sono a disposizione di qualsiasi interessato che ne faccia richiesta.
Versteigerungsbedingungen
- Die Lose werden im Laufe der Versteigerung, im Saal zugeschlagen.
- Die Lose können bei dem “The Charles Hotel”, in Sophienstraβe 28, 80333, München, Deutschland am 11. November 2015 von 10.30 Uhr bis 19.00 Uhr besichtigt werden.
- Die Gebote können über unsere Websites (www.bertolami.it, www.acrauctions.com, www.artcoinsroma.com), oder durch das Sixbid (www.sixbid.com), Numisbids (www.numisbids.com), oder durch die Fernkopie, durch E-mails, telefonisch, oder direkt bei dem Sitz von ACR Auctions gemacht werden. Die Gebote, die durch E-mails oder durch unsere Website gemacht sind, können nur für die Lose 1-586 bis 12.00 Uhr des 11. November 2015 gemacht werden und können nur für die Lose 587-1192 bis 12.00 Uhr des 12. November 2015 gemacht werden. Die Gebote, die durch Numisbids gemacht sind, können nur bis 12.00 Uhr des 11. November 2015 gemacht werden.
- Das Mindestangebot fĎ‹r jedes Los beträgt 80% des Schätzwertes. Die Gebote, die niedriger als 80% des geschätzten Wertes sind, werden nicht in Betracht gezogen.
- Bei gleichem Gebot für dasselbe Los, und falls keine weiteren Angebote im Saal stattfinden, wird das Los auf dem zuerst gemachten Angebot zugewiesen.
- Im Falle dass ein Los nur ein Gebot bekommt, bleibt der Betrag des Zuschlags derselbe des Grundpreises. Zum Beispiel: Grundpreis: € 1.000,00. Betrag einziges Gebot: € 1.500,00. Das Los wird dem Besteller, der das einzige Gebot gemacht hat, für € 1.000,00 zugeschlagen.
- Im Fall, dass ein Los mehrere Gebote bekommt, wird der Betrag des Zuschlags, durch eine vorher festgesetzte Erhöhung (Siehe Tabelle “Predeterminedincrease”), die auf das niedrigere Gebot hinzugefügt wird, berechnet. (Siehe Tabelle am Ende, für die vorgegebene Steigerung). Zum Beispiel: Grundpreis € 1.000,00. Bieter (A) Gebot € 1.270,00. Bieter (B) Gebot € 1.800,00. In diesem Fall, wird das Los dem Bieter (B) mit dem Betrag von € 1.370,00 (d.h. mit der vorher festgesetzten Erhöhung, wie man aus der Tabelle ersehen kann ) zugeschlagen.
- Die Liste der Zuschläge wird von ACR Auctions auf der Websites, nur für Informationszwecke bis 5 Tage nach der Schließung der Versteigerung veröffentlicht.
- Die Zahlung der zugeschlagenen Lose kann auf folgende Weise vor sich gehen:
- Bankscheck oder Rundscheck nicht übertragbar auf ACR Auctions GmbH eingetragen, mit dem Zusatz von der Rechnung von € 5 für ausländische Schecks.
- Banküberweisung für ACR Auctions GmbH mit dem Zusatz von der Rechnung von € 10 (für außereuropäischen Überweisungen) auf einer unserer nachstehenden Konten zu leisten:

- Die Lose, die mit Methode Livebidding zugeschlagen werden, haben eine Erhöhung von 2,5% des Betrags des Zuschlags.
- Die Zahlung der zugeschlagenen Lose, muss bis spätestens zehn Tage nach Erhalt der Rechnung erfolgen. Nach dem dreißigsten Tage ab dem Datum der pro-forma Rechnung, werden 1% an Verzugszinsen berechnet.
- Die Kosten der Verzollung und des Versands sind zu Lasten des Käufers. Sollten die Münzen ohne Rechtfertigung der ACR Auctions zurückgegeben werden, werden die Zollgebühren und die Speditionskosten zu Lasten des Kunden verrechnet.
- ACR Auctionsbehält sich das Recht vor, jedes Los von der Versteigerung zurückzuziehen. Während der Versteigerung, ist der Auktionsleiter berechtigt die Lose zu vereinigen oder zu trennen oder er kann die Versteigerung in veränderter Reihenfolge vornehmen. . Der Auktionsleiter kann die Lose zurückziehen, sollten die Gebote der Versteigerung nicht den Preis der zwischen dem Verkäufer und ACR Auctions vereinbart ist, erzielen.
- Der Käufer ist verpflichtet für jedes Lot eine Provision von 22% auf den Preis des Zuschlags, anACR Auctions zu bezahlen.
- Alle Teilnehmer an der Versteigerung müssen vor der Versteigerung eine Karte mit Angaben bezüglich der persönlichen Daten sowie alle weiteren geforderten Informationen ausfüllen, um die Gültigkeit auf den Zuschlag zu haben. Um Einkäufe zu machen, müssen alle Käufer die vom Gesetz erforderte Handlungsfähigkeit besitzen.
- ACR Auctionskann durch Mitbieten des Auktionsleiters an der Versteigerung, Aufträge für den Zuschlag akzeptieren. ACR Auctions behält sich das Recht vor, die Gebote von unbekannten Käufern zu verweigern, es sei denn, dass ein Depot, in der Höhe des gesamten Werts der gewünschten Lose oder eine angemessene Garantie geliefert werden.
- Die Schätzwerte jedes Loses sind im Katalogunter der Beschreibung der Lose gedruckt sichtbar, und sie enthalten keine Auktion Rechte wegen der Empfänger. Diese Schätzwerte sind als annähernd anzusehen.
Die Beschreibung der Lose im Katalog kann mittels öffentlicher Mitteilung während der Versteigerung korrigiert werden.
- Die Lose mit mehreren Münzen, die nicht illustriert sind, werden als gesehen und gewünscht verkauft und können nicht zurückerstattet werden.
- Die Echtheit der Münzen ist garantiert.
- Im Falle von Abweichungen, herrscht die italienische Version dieser Geschäftsbedingungen.
Allgemeine Geschäftsbedingungen
1- Anwendungsbereich
Nachfolgende Allgemeine Geschäftsbedingungen finden bei allen Geschäften zwischen ACR Auctions GmbH und den Kunden Anwendung. Eine Gültigkeit von Voraussetzungen, die von diesen Allgemeinen Geschäftsbedingungen abweichen, wird ausdrücklich ausgeschlossen. Dieser Einspruch gilt auch für den Fall, dass der Besteller für den Einspruch in einer besonderen Form vorgeschrieben hat. Ist ein Einspruch ausgeschlossen, so treten die gesetzlichen Bedingungen an Stelle der widersprechenden Bedingungen ein. Unterschiedliche Geschäftsvoraussetzungen werden nur dannwirksam, wenn ihre Anwendung von uns schriftlich bestätigt worden ist.
2- Vertragsabschluss
Die Bestellung stellt ein verbindliches Angebot für den Abschluss eines Kaufvertrages dar.
Ein rechtsgültiger Kaufvertrag kommt erst dann zustande, wenn wir Ihr Angebot innerhalb von 14 Tagen angenommen haben.
Dies erfolgt durch schriftliche Bestätigung unsererseits oder durch die Versendung der bestellten Produkte an Sie.
Eine über das Internet durchgeführte Bestellung werden wir unverzüglich durch E-Mail an die von Ihnen mitgeteilte E-Mail-Adresse bestätigen.
Die Bestätigung stellt jedoch noch keine verbindliche Annahme seitens ACR Auctions der Bestellung dar.
Für die Richtigkeit, Vollständigkeit und Aktualität der dargestellten Texte und Abbildungen im Internet und der Katalogewird keine Gewähr übernommen.
Im Falle offensichtlicher Druckfehler übernimmt die Gesellschaft keine Haftung.
Angebote müssen schriftlich gestellt werden. Etwaige mündliche Angebote sind unverbindlich.
Die Abgabe eines Gebotes bedeutet die Anerkennung unsere allgemeinen Geschäftsbedingungen.
3- Versand- und Versicherungskosten
Die Kosten für Versand und Versicherung der gekauften Lose werden nach den auf unserer Website www.artcoinsroma.com veröffentlichten Tabellen berechnet (de, en, co.uk).
4- Lieferung, Lieferfrist
Die Lieferung der erworbenen Objekte, insbesondere an uns unbekannte Käufer, soweit nicht anderes vereinbart, erfolgt nur gegen Vorauszahlung.
Im Falle eines Zuschlags wird dem Käufer eine Rechnung zugestellt, die innerhalb von 10 Tagen zu begleichen ist.
Nach erfolgter Zahlung wird die Ware innerhalb von 14 Tagen zugestellt.
Sollten wir aufgrund unvorhersehbareintretender Ursachen, wie Arbeitsunterbrechung, Sperrungen, behördlichen Anordnungen oder anderen Fällen höherer Gewalt vorübergehend daran gehindert sein den Kaufgegenstand innerhalb der vereinbarten Frist zu liefern,so verlängert sich diese Frist automatisch bis zur überwindung der Hindernisse.
Wir werden in diesem Fall den Kunden unverzüglich über die Ursachen der Hindernisse und deren voraussichtlichen Dauer zurKenntnis bringen. Dauert die Behinderung länger als vier Wochen, so haben beide Parteien das Recht, von dem Kaufvertrag zurückzutreten.
Der Käufer übernimmt die Verantwortung für eventuelle Schäden oder Verderben des Kaufguts im Moment der Zustellung des Kaufguts. Sollte das Kaufgut durch Spediteur zugestellt werden, liegt die Verantwortung bis erfolgter Zustellung bei der Speditionsfirma.
Das Kaufgut wird als zugestellt angesehen auch wenn es der Käufer mit Verspätung abholt.
Der Transport durch den Spediteur ist durch angemessene Versicherungpolizze gedeckt.
5- Zahlung
Alle Preise verstehen sich in Euro, inklusive der zum Zeitpunkt der Bestellung geltenden gesetzlichen Mehrwertsteuer.
Etwaige weitere anfallende Steuern, wie Einfuhr- und Ausfuhrsteuern sind zu Lasten des Kunden.
Der Kunde soll sich diesbezueglich selbstständig erkundigen oder mit uns Kontakt aufnehmen.
Die Bezahlung muss innerhalb von 10 Tagen nach dem Erhalt der Rechnung auf eines der unten angeführten Konten erfolgen.

6-Rücktrittsrecht
Der Kunde kann das Widerrufsrecht innerhalb von 7 Tagen ab dem Datum der Übergabe der Ware auszuüben. Dieses Recht kann vom Kunden nur ausgeübt werden, wenn der gute hat schwerwiegende Mängel nicht sichtbar und nicht in der Beschreibung angegeben. Die Rücktrittserklärung istan:

Widerrufsfolgen
Im Falle eines gültigen Rücktritts müssen beide Parteiendie eventuell empfangenen Vorteile (z.B. Zinsen) zurückerstatten).
Sollte keine Möglichkeit bestehen das Kaufgut zurückzuerstatten oder im Falle dass die Güter teilweise oder total beschädigt sind ist der Käufer verpflichtet Schadenersatz zu leisten.
Der Käufer muss keinen Schadenersatz leisten sollte das Kaufgut noch vor der Spedition beschädigt worden sein.
Die nicht versendbaren Güter werden von ACR Auctions an Ihrer Adresse abgeholt.
Die Zurückzahlung muss innerhalb von 30 Tagen durchgeführt werden.
Die Rückzahlungsfrist beginnt für den Käufer mit der Absendung der Ruecktrittserklaerung oder mit dem Versand der Güter, für unsere Gesellschaft mit dem Datum der Rückerstattung derselben.
7- Eigentumsvorbehalt
ACR Auctions hat das Recht, Güter die während der Ausübung seiner Tätigkeit abgeliefert wurden, zu verkaufen.
Der Verkäufer übergibt durch die Vergabe der Verkaufsgüter alle Rechte an ACR Auctions.
Bei Verträgen mit Privatpersonen behalten wir uns den Besitz der Ware bis zur vollständigen Bezahlung des Kaufpreises vor.
Bei Verträgen mit Händlern behalten wir uns das Eigentum der Ware bis zur Begleichung aller Forderungen der laufenden Geschäftsbeziehung vor.
Solange der Kaufpreis noch nicht vollständig bezahlt ist, ist der Kunde verpflichtet,
a) die Ware sorgfältigaufzubewahren, insbesondere Münzen nicht zu reinigen und mit chemischen Mitteln oder anderen Gegenständen zu behandeln.
b) einen Zugriff Dritter auf die Ware, etwa im Fall einer Pfändung, etwaiger Beschädigung oder deren Zerstörung nicht zu gestatten.
c) einen Besitzwechsel der Ware, sowie den Wechsel des eigenen Wohnsitz uns unverzüglichzu melden.
Wir sind berechtigt, die Ware im ordentlichen Geschäftsverkehr weiterzuverkaufen. Er tritt uns bereits jetzt alle Forderungen in Höhe des Rechnungsbetrages ab, die ihm durch die Weiterveräußerung gegen einen Dritten erwachsen. Wir nehmen die Abtretung bereits jetzt an. Nach der Abtretung ist der Unternehmer zur Einziehung der Forderung berechtigt. Wir behalten uns allerdings vor, die Forderung selbst einzuziehen, sobald der Unternehmer seinen Zahlungsverpflichtungen nicht ordnungsgemäß nachkommt und in Zahlungsverzug gerät.
8- Mängelhaftung
Sollten gelieferte Artikel offensichtlich Mängel oder Transportschäden aufweisen, ist der Kaeufer verpflichtet solche Mängel unverzüglich der ACR Auctions zu melden.
Das Versäumnis dieser Anzeige hat allerdings für Ihre gesetzlichen Kaufrechte, sofern Sie Privatperson sind, keine Folgen.
Es ist möglich, dass einzelne Stücke in mehreren Exemplaren vorhanden sind. Es können nicht immer alle Stücke in einem Katalog oder auf der Webseite abgebildet oder geführt werden. Die Lieferung eines nicht abgebildeten gleichen Stückes stellt keinen Mangel dar, außer Sie haben ausdrücklich in Ihrer Bestellung darauf hingewiesen, dass Sie exakt das abgebildete und beschriebene Stück ersteigern wollen.
Die Echtheit aller in der Versteigerung angebotenen Ojektewird gewährleistet. Dem Besteller stehen alle vom Gesetz vorgesehenenGewährungsrechte zu.
Der Privatkunde hat die Möglichkeit , falls machbar, die Beseitigung des Mangels oder die Lieferung gleichwertiger schadenfreier Güter zu verlangen.
Im Gewährleistungsfalle ist der Verbraucher nach seiner Wahl zur Geltendmachung eines Rechts auf Mängelbeseitigung oder Lieferung mangelfreier Ware berechtigt (Nacherfüllung).
Sollte die gewählte Art der Nacherfüllung mit unverhältnismäßig hohen Kosten verbunden sein, beschränkt sich der Anspruch auf die jeweils verbliebene Art der Nacherfüllung.
Weitergehende Rechte, insbesondere die Rückgängigmachung des Kaufvertrages, können nur nach Ablauf einer angemessenen Frist zur Nacherfüllung oder nach zweimaligen Fehlschlagens der Nacherfüllung oder auch im Falle einer Verweigerung unsererseits der Nacherfüllung geltend gemacht werden.
Handelt es sich bei dem Verkäufer um einen Händler, so sind wir innerhalb eines Jahres nach Lieferdatum nach unserer Wahl zur Mängelbeseitigung oder Lieferung mangelfreier Ware im Sinne des § 439 BGB berechtigt. Nach Ablauf eines Jahres ab Lieferdatum beschränken sich die Gewährleistungsansprüche des Unternehmers auf Mängelbeseitigung oder Zeitwertgutschrift nach unserer Wahl.
9- Datenschutz
Alle personenbezogenen Daten werden grundsätzlich vertraulich behandelt und nicht an Dritte weitergegeben.
10- Haftungsbeschränkung
In allen Fällen, in denen wir aufgrund vertraglicher oder gesetzlicher Anspruchsgrundlagen zum Schadens- oder Aufwendungsersatz verpflichtet sind, haften wir nur, soweit uns Vorsatz, grobe Fahrlässigkeit oder eine Verletzung von Leben, Körper oder Gesundheit zur Last fällt.
Unbetroffen bleibt die verschuldensunabhängige Haftung nach dem Produkthaftungsgesetz.
Unbetroffen bleibt auch die Haftung für die schuldhafte Verletzung wesentlicher Vertragspflichten; die Haftung ist insofern jedoch, außer in den Fällen der Sätze 1 und 2, auf den vorhersehbaren, vertragstypischen Schaden beschränkt.
Eine Änderung der Beweislast zum Nachteil des Kunden ist mit den vorstehenden Regelungen nicht verbunden.
Die angeführten Anordnungen sind nicht mit einer Anderung zum Nachteil des Kunden verbunden.
11- Anwendbares Recht und zuständiges Gericht
Im Falle eines Rechtstreits ist das Gericht in München zuständig.
Es gilt deutsches Recht mit Ausnahme des UN-Kaufrechtes für Verträge für den internazionalen Verkauf von Gütern.
Ist der Kunde Händler, juristische Person des öffentlichen Rechts oder öffentlichen-rechtlichen Sondervermögens, ist ausschließlicher Gerichtsstand für alle Streitfälle aus diesem Vertrag der Geschäftssitz der ACR Auctions GmbH, München. Dasselbe gilt, wenn der Kunde keinen allgemeinen Gerichtsstand in der Bundesrepublik Deutschland hat oder der Wohnsitz sowie der gewöhnliche Aufenthalt zum Zeitpunkt der Klageerhebung nicht bekannt ist.
Sollten einzelne Bestimmungen des Vertrags, diein dieser AGB angeführt sind ganz oder teilweise unwirksam sein, so wird hierdurch die Wirksamkeit der übrigen Bestimmungen nicht berührt.
Regelungen die als vollständig oder teilweise unwirksam betrachtet werden,können durch wirtschaftlich gleichwertigen Regelungen ersetzt werden.
Im Falle einer unvorhergesehenen Schwierigkeit werden die Parteien eine Regelung treffen, die dem nach dem gesamten Vertragsinhalt erkennbaren Parteiwillen zur Durchsetzung verhilft.
Mit der Teilnahme an einer Auktion sowie der Abgabe eines Gebots erkennen Bieter und Käufer diese Allgemeinen Geschäftsbedingungen an, die jedem Interessenten auf Anfrage vorgelegt werden.
